Terms of Service
These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for the use of the real estate information analysis service "Tokyo Precision Estate AI" (hereinafter referred to as the "Service") provided by Tokyo Precision Estate AI (hereinafter referred to as the "Provider"). All users (hereinafter referred to as "Users") must agree to these Terms before using the Service.
Article 1 (Applicability)
- These Terms apply to all relationships between the User and the Provider concerning the use of the Service.
- The Provider may establish rules, regulations, or other specific provisions (hereinafter referred to as "Individual Provisions") regarding the Service in addition to these Terms. Regardless of their name, such Individual Provisions shall constitute a part of these Terms.
- In the event of any conflict between the provisions of these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.
Article 2 (Nature of Service)
- Nature of Information: The Service is an information analysis tool that uses machine learning algorithms to perform statistical analysis of publicly available real estate information and provide proprietary indicators (such as Fair Value Scores). The information provided by the Service does not guarantee future real estate prices or the successful conclusion of transactions.
- Not Investment Advice: The Service does not conduct investment advisory business. Final decisions regarding the purchase or investment in real estate must be made by the User at their own risk.
- Not Legal or Tax Advice: Information provided regarding real estate laws, regulations, and taxes (including but not limited to foreign ownership rights) is for general informational purposes only and does not constitute legal or tax advice. The Provider does not guarantee that such information is accurate, complete, or current. Laws and regulations are subject to change, and the User should consult with a qualified attorney or tax accountant for specific advice.
- Information Sources: The Service references publicly available real estate information. The Provider is not affiliated with the operators of the source websites. The User acknowledges in advance that the functions of the Service may be restricted or suspended without notice due to specification changes, maintenance, or access restrictions by the source websites.
Article 3 (Registration and Eligibility)
- Geographic Restriction: The Service is intended solely for users residing outside of the European Economic Area (EEA) and the United Kingdom. By registering for the Service, the User warrants that they are not a resident of the EEA or the UK.
- Those wishing to use the Service shall apply for registration through the payment platform designated by the Provider (such as LaunchPass) after agreeing to these Terms. The usage contract is formed when the payment is completed.
- Account Requirements: To prevent fraudulent use, a Discord account with a verified mobile phone number (SMS authentication) is required to use the Service. Participation in the server may be restricted for accounts that have not completed verification.
- The Provider may not approve an application for registration, or may cancel the usage
contract ex post facto, if it determines that the applicant falls under any of the
following, and shall not be obliged to disclose the reason:
- If false information is provided during the application.
- If the applicant is a resident of the EEA or the UK.
- If the applicant has previously violated these Terms.
- If fraudulent intent is suspected, such as the same person using the free trial multiple times.
- If the Provider determines that the applicant is an Anti-Social Force (meaning organized crime groups, criminal syndicates, racketeers, or other equivalent persons) or has any interaction or involvement with such groups.
- In any other case where the Provider deems the registration to be inappropriate.
Article 4 (Management of Login Information)
- Users shall manage the account information (Discord account, etc.) necessary for using the Service at their own responsibility.
- Users may not transfer, lend, or share account information with a third party under any circumstances.
Article 5 (Fees and Payment Methods)
- Currency: All usage fees for the Service are denominated and charged in United States Dollars (USD). If the User pays with a credit card issued in a currency other than USD, foreign transaction fees or exchange rates determined by the card issuer may apply.
- Users shall pay the usage fees separately determined by the Provider and displayed on this website as consideration for the paid portion of the Service, through the payment processing company designated by the Provider (Stripe, etc.).
- If payment cannot be confirmed due to credit card expiration, insufficient funds, etc., the Provider may suspend the provision of the Service (including paid membership privileges within Discord) or terminate the contract with the User without prior notice.
- Fee Changes: The Provider may revise usage fees due to changes in economic conditions or service enhancements. In the event of a change in usage fees for existing paid members, the Provider shall notify Users at least 30 days in advance. If a User does not agree to the change, the User may terminate the contract.
Article 6 (Subscription and Cancellation)
- Contract Period: The contract period for the subscription plan shall be the period selected by the User at the time of application (monthly or yearly).
- Time Zone: All dates and times referred to in these Terms (including renewal dates and maintenance schedules) shall be based on Japan Standard Time (JST).
- Auto-Renewal: Unless cancellation procedures are completed by the end of the contract period (JST), the contract shall be automatically renewed under the same conditions.
- Cancellation: Users may cancel their subscription at any time through the
management screen of the payment platform. Even if cancelled, no refund (including pro-rated
refund) will be made for usage fees already paid, but the Service can continue to be used
until the next scheduled renewal date.
※ Note: Leaving the Discord server does NOT constitute cancellation of this usage contract. Please note that billing will continue if you leave the server without completing the cancellation procedure.
Article 7 (Intellectual Property Rights)
- Copyrights and all other intellectual property rights regarding the AI analysis models, algorithms, source codes, and proprietary analysis results (undervalued scores, confidence interval data, etc.) provided in the Service belong to the Provider or the licensors of the Provider.
- Users shall not copy, sell, publish, or publicly transmit information obtained through the Service beyond the scope of private use.
- Lawful Analysis: The User acknowledges that the data collection and analysis performed by the Service are conducted lawfully in accordance with Japanese law, specifically Article 30-4 of the Copyright Act of Japan, which permits the use of copyrighted works for information analysis and data processing.
Article 8 (Prohibited Acts)
Users must not engage in the following acts when using the Service:
- Acts that violate laws or public order and morals.
- Acts related to criminal activity.
- Acts that infringe on the copyrights, trademark rights, or other intellectual property rights contained in the Service.
- Acts that destroy or interfere with the functions of the server or network of the Provider, other users, or third parties.
- Data Leakage: Disclosing, providing, leaking, or reposting information obtained through the Service (including but not limited to text, images, and analysis results) to third parties who are not members of the Service, by any means (including Discord forwarding, screenshots, or copy-pasting).
- Acts of using information obtained through the Service for commercial purposes (resale of data, redistribution, etc.).
- Acts of creating multiple accounts by the same person to repeatedly use the free trial.
- Acts that may interfere with the operation of the Provider's services.
- Unauthorized access or attempts to do so.
- Acts of collecting or accumulating personal information about other users.
- Acts of using the Service with fraudulent intent.
- Acts that cause disadvantage, damage, or discomfort to other users of the Service or other third parties.
- Acts of impersonating other users.
- Advertising, publicity, solicitation, or business activities on the Service not authorized by the Provider.
- Other acts deemed inappropriate by the Provider.
Article 9 (Suspension of Service Provision, etc.)
- The Provider may suspend or interrupt the provision of all or part of the Service without
prior notice to the User if it determines that any of the following grounds exist:
- When performing maintenance checks or updates on the computer system related to the Service.
- When provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster.
- When computers or communication lines stop due to an accident.
- When data collection becomes difficult due to specification changes, access restrictions, etc. of the reference real estate portal sites.
- In other cases where the Provider determines that provision of the Service is difficult.
- The Provider shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service.
Article 10 (Usage Restrictions and Deregistration)
- The Provider may restrict the User from using all or part of the Service or deregister the
User without prior notice in the following cases:
- If any provision of these Terms is violated.
- If it is found that there is a falsehood in the registered information.
- If there is no response to contact from the Provider for a certain period.
- In other cases where the Provider deems the use of the Service to be inappropriate.
- The Provider shall not be liable for any damages caused to the User by actions taken by the Provider based on this Article.
Article 11 (Disclaimer of Warranty and Immunity)
- The Provider does not expressly or implicitly warrant that the Service is free from de facto or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, infringement of rights, etc.).
- The Provider shall not be liable for any damages arising from the use of the Service, except in cases of intentional misconduct or gross negligence by the Provider. However, if the contract between the Provider and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act of Japan, this exemption clause shall not apply.
- Even in the case provided for in the proviso to the preceding paragraph, the Provider shall not be liable for damages arising from special circumstances (including cases where the Provider or the User foresaw or could have foreseen the occurrence of damage) among damages caused to the User by default or tort due to the Provider's negligence (excluding gross negligence). In addition, compensation for damages caused to the User by default or tort due to the Provider's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which the relevant damage occurred.
Article 12 (Changes to Service Content)
The Provider may change, add, or abolish the contents of the Service with prior notice to the User, and the User shall consent to this.
Article 13 (Changes to Terms of Service)
- The Provider may change these Terms without requiring individual consent from the User in
the following cases:
- When the change to these Terms is compatible with the general interests of the User.
- When the change to these Terms is not contrary to the purpose of the usage contract and is reasonable in light of the necessity of the change, the appropriateness of the content after the change, and other circumstances pertaining to the change.
- The Provider shall notify the User in advance of the fact that these Terms will be changed, the contents of these Terms after the change, and the effective date thereof.
Article 14 (Handling of Personal Information)
The Provider shall appropriately handle personal information obtained through the use of the Service in accordance with the Provider's "Privacy Policy".
Article 15 (Notification or Contact)
Notification or contact between the User and the Provider shall be made by the method determined by the Provider. Unless the User notifies the Provider of a change in accordance with the method separately determined by the Provider, the Provider shall consider the currently registered contact information to be valid and verify such contact information, and these shall be deemed to have reached the User at the time of transmission.
Article 16 (Prohibition of Assignment of Rights and Obligations)
Users may not assign their status under the usage contract or rights or obligations based on these Terms to a third party or offer them as collateral without the prior written consent of the Provider.
Article 17 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by the laws of Japan.
- In the event of a dispute regarding the Service, the district court having jurisdiction over the location of the Provider's head office shall be the exclusive agreement jurisdictional court.
